I had an alarm on my septic go off & I called & was able to speak to a live person even after hours. A technician was able to come out in two day & do the repair & resolve the issue. Happy with the results.

Aerobic Septic System Chlorine Problem (Too Much Chlorine)

Comal County Septic System Rules

Septic system legal requirements in Comal County can be confusing. Here's what you need to know in plain English.

Do I have to have a maintenance contract?

For the first two years after a system is installed, yes. Texas requires a signed two-year service policy on file with the county before a new system can be used. After that, Comal County lets the owner of a single-family home maintain their own aerobic system, so from year three a contract is a choice rather than a legal requirement.

Can I maintain my own system if the house is a rental?

No. Maintaining your own system is only allowed on a single-family home you own and live in. Rentals, spec homes, multi-family and anything commercial all have to stay under a licensed maintenance provider. This one catches a lot of people who move out and keep the house.

If I maintain it myself, do I have to report to the county?

No. Homeowners who maintain their own system file nothing with Comal County. Licensed providers have to submit test reports within 14 days of each visit, so if we maintain it the paperwork gets filed for you and there is a record the system was serviced.

Do I have to inspect my own system three times a year?

Yes. An aerobic system is built around three checks a year, roughly every four months: chlorine, sludge level, the air pump, the sprayheads and the alarm. Enforcement is light, but the system still needs it, and skipping it is how a cheap fix turns into an expensive one.

Can I just NOT check my septic system and wait for something to go wrong?

No, and it is the most expensive way to own one. An aerobic system fails quietly: a dead air pump or a stuck float does not announce itself, and by the time you smell something or the alarm sounds you are usually looking at a repair instead of an adjustment. Remote monitoring is the closest thing to leaving it alone. The state allows two visits a year instead of three once a system reports its own status, and you hear about a problem the day it happens rather than up to four months later. That is what Luna 360 does.

Can I get in trouble over my septic system?

Comal is a complaint-based county. Nobody comes looking, but if a neighbor complains you will hear from them. The county investigates, and if the system is out of compliance you get a notice of violation. Ignore that and it goes to court.

What actually makes a neighbor complain?

Odor, almost every time. The usual case is a neighbor smelling effluent from someone else's sprinklers. If your system has started to smell, that is the warning shot, and it is far cheaper to deal with before the call is made.

What are the fines?

The county cannot fine you directly. It has to go through the court, where an initial fine is typically around $87. If the district attorney puts you on a deferral and you still do not comply, fines commonly reach $1,000.

How long do I have to fix a failing system?

It shortens every time. The first time you are given 30 days to begin repairs. A second time within 12 months drops it to 20 days, and a third drops it to 10. Repeated violations within a three-year period can also cost you the right to maintain the system yourself.

How far does my spray field have to be from the property line?

At least 20 feet, so spray cannot drift onto a neighbor's land. The area set aside for your septic system also cannot be used for anything else, which means no structures, no water wells and no retention ponds over it.

How long does a septic permit take in Comal County?

Plan on a month to a few months. Plans have to come from a septic engineer and meet the setback rules before anything is submitted, and that stage is what varies most. Once the county has them, admin review takes a couple of days and technical review runs two to three weeks. Anything other than a single-family home adds roughly 10 more days because it goes to the state. A permit is required no matter how much land you own.

Can I get my system serviced if I am not on a contract?

Yes. We charge a service fee for anyone not on a contract when we look at or inspect a system. Get in touch and we will get you on the schedule.
